On September 1st it was 2 years since I purchased my Magnum! WOOHOO! And almost to the day we celebrate by having another IDIOT REAREND ME! AAAARGH!
It's 6:30am on a Sunday.. ON A SUNDAY! Hardly anyone else is on the road. I'm taking the wife to work when we come upon a stoplight. Again, I remind you not many other people are out this early ON A SUNDAY!
I was in the right lane. Two other lanes to the left and only the right turn lane next to me on the right, and ALL of these lanes are empty! I'm waiting for the light to turn green and when it does... WHAM!
Now, I didn't even notice if this guy was even in back of me. Usually I see headlights in the rearview, but I don't even remember seeing him. Hell, at 6:30 in the morning, I'm barely aware of anyghint else going on around me except for what I'm looking at ahead of me.
From what he said, he was stopped behind me - he was reading some kind of paper (he deliveres news papers) when he said he saw the light turn green but he didn't notice I hadn't moved yet. WTF! I'm the only car in front of him! Plus the fact that he had that bright LED spoiler light hitting him in the face!
I get out and look and to my amazement the damage didn't look so bad...At least not until he backed his car up. OMFG! My bumper is all pushed in, my right exhaust pipe along with it. And to make matters worse, I open the liftgate to see if there's any other damage and when I go to close it, IT WONT CLOSE! Son of a B!TCH!
Now get this... I get on my cell to call the Police and he asks if that's what I'm doing. I just look at him with an evil sneer and he says to wait because we can take care of it right there.
"HA!" I say laughingly, "Do you have $1200 to give me right now?"
"$1200? That don't cost no $1200!" He says.
I again laugh at him and proceed to call the cops.
When the Police finally arrive, she estimates (I know, they're not the greatest at estimating damage, but hey, check this out --> ) the damage to be around $1500! Of course I agree with her and we are on our way. The kid gets a ticket for failure to reduce speed and careless driving.
Two hours later I get a call from his insurance company. "Pretty quick", I thought to myself, and on a Sunday morning too. He proceeds to interview me about the incident and I tell him. He wants me to come down to the office so he can give me an estimate and send me on my merry ol' way t one of their body shops.
HA! I don't think so!
Last time this happened the bodyshop botched it all up. There's overspray everywhere, they painted a door with the trim still on it and I have DA marks on the lower corner of my windshield. So I told him I'm taking it to one of my shops, maybe even the dealer.
But then I remember reading something a while back about a little thing called Depreciated Value. It's something that you can sue for when you get into an accident that is not your fault. Depreciated Value is when the car has been damaged in an accident and it depreciates it's resale value.
"Very good", I think to myself. This time around, I'm getting a lawyer and suing. After all, he was on the job, working for some News Paper. This time, it's payback!
Any lawyers in the house that can offer up some advice? I'd surely appreciate it.
