    Charger Smashed - Need Advice Please

    I was on my way to lunch this afternoon and from out of nowhere a woman ran a marked stop sign and smashed into my Charger SRT8. The accident occurred on private property and when I called the Orange, CA police they said they would not come out to file a police report because the accident is on private property.

    The only proof I have that this happened are pictures I captured with my cell phone. They are here:

    I had the other party call her insurance and file a claim. She told her insurance that "she did not see the stop marking" but she did say that she hit me. The reason why I am a little worried is that she only told the associate with her insurance company that and not her adjuster. I am waiting to her what her statement is to the adjuster now. I sent these same pics to her Adjuster.

    The thing is, she blew right through the stop because she said she didn't see it but based on pic one, you can clearly see it's marked on the road.

    One thing I forgot to mention, she was driving a company car and we initiated the claim through her insurance, not mine. I am hoping that the fault is 100% hers and my insurance co. doesn't need to get involved.

    The estimate I was given was for $3,200, just for my car.

    Since both of our cars met almost bumper to bumper, am I at fault in any way?

    Damn, I dont see why you should be, it looks like she pulled out in front of you, I hope things work out.

    Maybe it's me but she looks a little elderly or aged. Late 50's or early 60's in age. Sorry about the damage. Doesn't look too bad.

    Yeah, she was pretty old. Doesn't look bad but the damage is behind the bumper - $3,200 worth.

    That sucks to hear and see...

    also that looks like Inglewood Best Buy... am I right?

    I see that you still can drive it... plus I know that you want to get it fixed right away... but if you can wait to take it in on Monday... cause I see that you are signed up for the Festival...

    Nope, Orange, CA (off of the 5 and Chapman).

    HB Dodge told me it is unsafe to operate but I have no other way to get to work and school. Until I can hear either way from her insurance, I'm driving it. My headlight doesn't work, the scuff plate is dragging, and the valance is loose.

    I'll try for this weekend but this just really puts a damper on everything. :(

    I understand... but just think about seeing all those LX's there,,,, you don't want to miss this event... it will put a smile on your face...

    I will get you a white vinyl sticker that reads "OUCH" and place it on the bumper... trust me... everyone will understand...

    lol. I'll put a donation cup in front for help with the deductible too j/k

    We'll see. I'm hoping that by Sat, this thing is already being patched up at the body shop.

    In NJ a person at a stop sign is automatically at fault, except because it's private property, that's not a stop sign. I don't know how the insurance companies would come up with liability on this one. It might come down to her statement on the claim. And it sounds like she didn't do the smart thing there.

    Dude that sucks. If its her fault, you wouldn't need to pay the deductible. Judging by this pic, she looks like she ran the stop mark and also is not in her lane.

    Yeah, she came flying across that intersection. I didn't see anything until the Infinity was resting a good 5 inches into my bumper.

    I'm hoping she accepts full liability.
