Unhappy AZ DPS Photo Radar van info.

I thought I might have been caught today on an exit ramp by an AZ DPS Photo Radar van so I did some research. There is a link to this picture on the DPS web page. This is how their photo radar vans work. They can capture up to 4 lanes not just 2 as shown in this example. It appears to me that the enforcement zone is only on the left side of the van. My exit ramp was on the right side. I also didn't see a flash. The van must be parked parallel to the lanes of travel. If the van is not parallel the captured speed will be off. My exit ramp was not parallel to the van. I think I'm safe.

Also, about just throwing the ticket away and waiting to be served by a process server: In Arizona you can be "served" with a ticket just left on your door or given to your spouse. A signature is not required. Direct in-person contact is not required. It seems like there's no point just ignoring it.

They can't just leave it on your doorstep. Where's the due process. If you go to court, ask to cross examine your accuser. Ask the camera questions.

In other states you have to be served in person and maybe a signature is required as well. Not like that in AZ unfortunately.

"The common advice to ignore mailed photo tickets, while technically legal, is at the root of many suspended licenses. The resulting deliveries from process servers land many accused speeders with a suspended license. If the process server hears or even smells human activity at the residence, he can attach the citation to the front door and move on to his next stop. If the drivers never actually see the ticket, their licenses will be suspended when they fail to show up in court."

"Process server Sheila Cahil says Arizona residents need to read the state law. "Every state has its own process serving laws. Some people have moved here from other states and think they have to be served in person or sign for it to be legal. That's never been the case in Arizona." "

"The server then submits a delivery affidavit to the court, even if the process server left the citation on the porch, with the landscaper or with a nine-year-old. A hearing date is then scheduled, and when the registered vehicle owners don't show, their licenses are suspended, even if they never knew of the citation and even if they weren't the actual the drivers."

    More info I found:

"Speed cameras that use side angle projection of the radar beam (Multanova), must be setup parallel to the traffic flow. Why? Because of the "Coseine Error Factor" which will cause the speed reading to be inaccurate - Either reading too high or too low, depending on how far off parallel the camera is pointing. This is why all speed cameras shouldn't be setup on curved roads, only straight roads."

So if you are wondering if you're driving on a suspended license...

    You can check here.

Why there? Think about this... What happens if you fail to appear in court? That's right, you get a warrant issued in AZ.

You can rest easy. You must be served within 90 days of the violation.
If past 90 days, wipe your butt with it, it's no good.

Go to the web site for New Times the paper here in the valley, search photo radar articles and read about being served. Most of the process servers say they served you, to get their pay per delivery, when in fact they never left their offices, A$$holes
