I bought a new 300 Touring 2.7L 3 weeks ago. I've noticed a couple of times when I the car was loaded with 5 adults and I was backing up a slight incline out of a parking space that the car jerks/shudders a bit. It feels like the transmission is slipping. Is this a defect? If so, is it common?

yeah, it happens to me too. .i think it is because of the parking brake
not depress all the way down.. it only happens at a slight incline and i
did have the transmission flush last week and it still does it unless
you applied brake before you shift reverse or maybe i am wrong?

Thanks for the reply.

I'm not sure I understand. Are you saying that you think it happens because the parking brake is partially engaged? Or because you don't use the parking brake at all when parking on the slight incline.

Slight chance that there may be a TSB. Everything is controlled by computers including the transmission. The transmission controller is located beside the steering column , probably much like your Mercedes. I'd at least mention to the dealer. Engaging the Ebrake on hills is always a good idea, anyway.
